The Masters thesis will resolve some important thesis for parties’ rights to claim for damages if other party breach the contract or agreement. This work is divided into four main sections: first part International contracts sales of goods and its relation to contracts for the carriage of goods by sea; the second part the biggest emphasis will be to draw on the contracts for the carriage of goods by sea; and the third part will be concentrated to applicable law in disputes arising from loss or damage of cargo or delay; and the fourth applicable jurisdiction in disputes arising from international contracts for the carriage of goods by sea.

This paper focuses on the impact that the ‘new approach to business failure’ has had on Italian out-of-court procedures. It will demonstrate that in 2005 Italian law started to embrace the rescue culture of out-of-court procedures by means of a series of reforms; initially, this movement facilitated the incorporation of the ‘new approach to business failure’, but – and this is the paradox – the more law makers and courts remove the old paradigms and introduce new ones, which in principle could make the procedures smoother, cheaper and more efficient, the more the law in the book and the law in action appear to be overloaded with additional prerequisites which make the procedures cumbersome…

Is the French mobile phone cartel really a cartel?

International audience; France Telecom (FT), SFR and Bouygues Telecom (BT) have been fined by France's Conseil de la Concurrence (CC) for organizing a mobile phone cartel with stable market shares (one-half, one-third and one-sixth, respectively) and for directly exchanging commercial information. While not contesting the legal decision, it is argued here that the economic reasoning is flawed. Zdecydowana większość emigracyjnych elit politycznych zajęła negatywne stanowisko w sprawie zbiórki pieniędzy na restytucję Zamku Królewskiego w Warszawie. W 1. połowie lat 70. XX w. na całym świecie działało jednak kilkadziesiąt komitetów i organizacji polonijnych wspierających ową inicjatywę, najwięcej w Stanach Zjednoczonych, Australii, we Francji i w Kanadzie. Chronologicznie pierwszy tego typu komitet zawiązał się jeszcze w czerwcu 1967 r. w Londynie, na kilka lat przed decyzją władz PRL w sprawie podniesienia z ruin byłej siedziby królewskiej.
